LUVR Membership Agreement

This Monthly Membership Agreement (“Agreement”) governs your participation in the LUVR Membership Program (“Membership”) offered through LUVR’s websites, applications, and related services (collectively, the “Site” or “Services”).
By enrolling in the Membership, you agree to be bound by this Agreement, together with LUVR’s Terms of Service and Privacy Policy.
If you do not agree, do not enroll or use the Services.
1. Eligibility and General Use
Membership is available only to individuals who are at least eighteen (18) years of age and who provide accurate and complete information at the time of enrollment.
You represent that you are legally permitted to enter into this Agreement and authorized to use the payment method designated for your Membership.
2. Enrollment and Free Trial
Enrollment in the Membership is optional and requires your affirmative selection at checkout or through your account. We do not use pre-ticked boxes.
Where Membership is added to your cart, the checkout will clearly display the trial period, monthly fee, and renewal terms.
New members are entitled to a complimentary twenty-one (21) day trial upon enrollment with a valid payment method.
You will not be charged during the trial period. At the end of the trial, unless you cancel, your Membership will automatically convert into a paid subscription as described below.
3. Auto-Renewal and Billing
After the trial, your Membership automatically renews every thirty (30) days at $29.99 USD per month, inclusive of VAT or other applicable taxes.
By enrolling, you authorize LUVR to charge your designated payment method on a recurring basis until you cancel.
Accepted payment methods include credit and debit cards, PayPal, and Google Pay.
If a payment fails, LUVR may retry or request updated payment details from your issuer. If payment cannot be completed, LUVR may suspend or cancel your Membership.
All transactions are processed and settled in U.S. Dollars (USD), regardless of displayed currency.
Prices exclude taxes, which are calculated at checkout based on your billing or shipping address.
International orders may incur import duties, VAT, or local charges, payable by the customer.
3A. Checkout Disclosures (Clear & Conspicuous)
Before payment, the checkout page will clearly disclose, adjacent to the payment consent button:

that charges will continue until you cancel,

how and where to cancel,

the amount and frequency of charges,

the payment method to be charged, and
-
the billing period length.
By clicking “Complete Purchase,” you provide affirmative consent to these recurring billing terms.
3B. Renewal Reminders (Annual Plans / Long Trials)
If LUVR ever offers annual plans or trials longer than one month, renewal reminders will be sent in accordance with state law (typically 30 days prior).

LUVR may adjust or update membership benefits at any time, provided such changes do not materially affect your statutory rights.
5. Cancellation
You may cancel your Membership at any time before your next billing date to avoid further charges.
You can cancel directly through your account (Account → Membership → Cancel), by using the form at https://tryluvr.com/pages/membership-cancellation-form, or by emailing support@tryluvr.com.
No cancellation fees apply.
If canceled during your trial, no charges will occur.
Your Membership remains active until the end of your current billing cycle, after which benefits end.
6. Membership Fees and Refunds
Membership fees are non-refundable once charged, except for duplicate payments or billing errors.
Digital benefits are non-refundable once accessed or made available.
Like a movie or concert ticket, once you’ve accessed digital perks (discounts, VIP products, warranty registration, etc.), they cannot be refunded—even if unused.
Cancellation ends future charges only.
7. Payment Information for Membership
To enroll, you must provide a valid payment method accepted by LUVR. You represent that your payment details are accurate and authorized.
You agree to update billing info as needed (e.g., address, expiration date, replacement card).
LUVR may rely on updated account details from your payment provider and charge any valid method on file.
Disputes must be reported within 30 days of the charge. Continued use after fee adjustments constitutes acceptance of new terms.
8. Free Shipping Benefit
Membership may entitle you to free standard shipping on all orders, subject to availability and location.
9. Communications Related to Membership
By enrolling, you consent to receive electronic communications from LUVR regarding your account, billing, and benefits.
These satisfy any legal requirement for written communication.
If you opt in to SMS or mobile alerts, you consent to receive recurring texts related to orders, membership, and promotions. Message and data rates may apply. Reply STOP to unsubscribe.
10. Membership Account Security
You are responsible for maintaining the confidentiality of your account credentials.
LUVR is not liable for losses resulting from unauthorized access to your account if your credentials were used.
Notify support@tryluvr.com immediately of any breach or unauthorized use.
11. Modification of Membership Terms
LUVR may update this Agreement at any time. If a change materially affects your rights, we will notify you at least 30 days in advance by email or notice on our website. Continued use after that period constitutes acceptance.
12. Termination of Membership
LUVR may suspend or terminate Membership for violations, misuse, fraud, or other reasons listed below:
(a) violation of these terms;
(b) law enforcement request;
(c) technical or security issues;
(d) prolonged inactivity;
(e) suspected fraud or abuse;
(f) conduct harmful to LUVR’s business.
LUVR shall not be liable for any termination or suspension under these circumstances.
13. Dispute Resolution for Membership
A. Scope and Governing Law
Your participation and any dispute arising from this Membership or related purchases are governed by the laws of the State of Florida, excluding conflicts of law.
Claims must be filed within one (1) year unless otherwise required by law.
B. Forum Selection for Non-Arbitrable Matters
The state and federal courts in Palm Beach County, Florida shall have exclusive jurisdiction over any non-arbitrable dispute. You consent to personal jurisdiction in those courts.
C. Pre-Arbitration Notice and Informal Resolution
Before arbitration or court action, the party seeking relief must provide written notice describing the dispute and requested resolution.

The parties will meet in good faith (phone or video) within 60 days to attempt resolution. Statutes of limitation are tolled during this period.
D. Agreement to Arbitrate
Except as noted in Section H, all disputes will be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
The Federal Arbitration Act (9 U.S.C. §§1–16) governs this clause.
E. Location, Format, and Procedures
The legal seat of arbitration is Palm Beach County, Florida.
Unless a hearing is requested within 10 days of filing, arbitration proceeds via documents-only format (“desk arbitration”).
Hearings, if any, may occur by video or phone.
F. Arbitration Demand Requirements
Each demand must include:

G. Arbitrability and Sequencing
The arbitrator decides all questions of enforceability and scope, except as reserved by law.
H. Small Claims Option
Either party may file an individual claim in Florida small claims court instead of arbitration.
I. Confidentiality
All arbitration proceedings, disclosures, and awards remain confidential to the extent allowed by law.
J. Relief and Court Involvement
The arbitrator may grant any lawful individual relief, including damages or injunctions.
Awards are binding only on the involved parties and may be enforced in any court of competent jurisdiction.
K. Fees and Costs
LUVR will pay arbitration fees exceeding normal court filing costs.
If you can’t afford arbitration fees, LUVR will cover them.
Frivolous claims may result in fee awards to the prevailing party.
L. Class and Representative Action Waiver
Claims must be brought individually, not as class or collective actions.
The arbitrator has no authority to consolidate claims or conduct representative actions.
M. Opt-Out Right
You may opt out of arbitration within 30 days by emailing support@tryluvr.com or mailing written notice to the address above.
The class-action waiver and Florida forum selection still apply.
N. Severability and Survival
If any part of this arbitration clause is invalidated, the rest remains effective.
This section survives termination of your Membership.
O. Notice to California Consumers
This arbitration clause does not waive rights under the California Automatic Renewal Law (Cal. Bus. & Prof. Code §17600 et seq.), but governs how disputes are resolved.
14. Governing Law and Jurisdiction (Subject to Section 13)
Subject to Section 13, this Agreement and any related disputes are governed by Florida law, with jurisdiction as outlined above.
15. Force Majeure
LUVR is not liable for any delay or failure caused by events beyond its reasonable control, including natural disasters, labor disputes, or internet outages.
16. Severability and Waiver
If any part of this Agreement is deemed unenforceable, the remaining provisions remain valid. Failure to enforce any right does not constitute a waiver.
17. Entire Agreement for Membership
This Agreement represents the complete understanding between you and LUVR regarding the Membership.
It supersedes all prior communications or understandings.
Nothing herein creates an employment or agency relationship between you and LUVR.
